Below are the answers to some common questions concerning divorce law in England and Wales. (The law relating to civil partnership dissolution is identical to divorce.)

The simple answer is no. The divorce process itself is now largely administrative and is done online.

But it is important, before the final step is taken, to be aware, of the legal effects of ending your marriage, particularly in relation to pensions.

We can give you full and clear advice about this so that you do not unintentionally put yourself in a potentially weaker financial position.

On 6 th April 2022, the Divorce, Dissolution and Separation Act (DDSA) 2020 came into force. There is now no requirement to prove that one spouse was to blame for the divorce. Instead, one or both parties simply need to make a statement that the relationship has irretrievably broken down. If only one party files for divorce (joint applications are allowed) the other spouse cannot ‘contest’ proceedings.

Under the DDSA 2020, there is a minimum period of 20 weeks between the start of the divorce process and the granting of a Conditional Order (formally a Decree Nisi). This is to provide parties with the opportunity to organise arrangements for their children and the financial settlement. It also provides space and time to allow parties to consider a possible reconciliation.
